the new no-fault divorce laws in new york state (drl Sec 170.7)
On August 15, 2010, then Governor David Patterson signed into law New York's No-Fault Divorce Law. The new subsection of New York's Domestic Relations Law (Sec 170.7) allows for a party to maintain an action for divorce to dissolve the marriage on grounds that "the relationship between husband and wife has broken down irretrievably for a period of at least six months, provided that one party has so stated under oath." This new provision allows one party to allege grounds and move forward to Equitable Distribution, Maintenance and Custody issues, but a divorce still cannot be granted until those and other issues are resolved uncontested or through litigation.
